1. Introduction and Acceptance
Welcome to Shwi Recharge. These Terms of Use ("Terms") govern your use of the Shwi Recharge website, platform, WhatsApp services, API, and related services ("Services") operated by SHWI AM (PTY) LTD ("Shwi", "we", "our", or "us"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services. We may update these Terms from time to time; continued use after changes constitutes acceptance.
2. Description of Service
Shwi Recharge is a prepaid digital recharge platform for businesses and organisations in South Africa. Through the Services you may fund a wallet and purchase airtime, mobile data, SMS, and prepaid electricity tokens for beneficiaries you manage. Features include single recharges, CSV batch uploads, scheduled and recurring orders, contact recharge requests, reporting, and API integration. Shwi is a technology platform - we do not operate mobile networks or municipalities. Recharge delivery depends on third-party networks and vendors.
3. Account Registration
To use the Services, an organisation owner or authorised representative registers an account. You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your password, API keys, and account credentials.
- Notify us promptly of any unauthorised access.
- Accept responsibility for all activity under your account and by users you invite.
You must be at least 18 years old and, if registering on behalf of a business, you represent that you have authority to bind that business. Email verification is required before dashboard access.
4. Unverified Account Limits
New organisations are unverified until Shwi completes organisation verification. While your organisation is unverified:
- Monthly wallet deposit limit: you may deposit up to R500.00 into your wallet per calendar month via EFT. This limit resets on the first day of each month.
- The limit applies to wallet top-ups (EFT deposits), not to spending wallet balance on recharges already funded.
- Shwi may request identity and/or business verification documents before lifting limits.
- You may request verification via WhatsApp or by contacting hello@shwi.co.za.
- Attempting to circumvent deposit limits (including using multiple accounts or misleading information) may result in suspension or termination.
Once verified, standard wallet and recharge limits apply as communicated by Shwi. We reserve the right to apply additional limits for risk, compliance, or legal reasons.
5. Wallet and Payments
The Services operate on a prepaid wallet model. You fund your wallet via EFT using the bank details shown in the dashboard or WhatsApp. You must use the correct payment reference so we can allocate your deposit.
- All prices are in South African Rand (ZAR) unless stated otherwise.
- Wallet funds may only be used for recharges and related Services on the platform.
- Wallet deposits and recharges are subject to our Refund Policy. All sales are non-refundable.
- We do not pay interest on wallet balances.
- Incorrect or unreferenced EFT payments may be delayed or returned at our discretion.
6. Recharge Transactions
You are solely responsible for the accuracy of MSISDNs, meter numbers, amounts, and product selections before confirming a recharge. Digital products (airtime, data, SMS, electricity tokens) are delivered immediately or shortly after submission. Once processed, recharges cannot be reversed or refunded.
If a recharge fails due to a system error on our side, we may credit your wallet balance - this is not a cash refund. Failures caused by invalid numbers, network unavailability, or recipient-side blocks are not refundable.
7. Beneficiaries, Contacts, and Data
You are responsible for the personal information of beneficiaries and contacts you upload or store on the platform. You warrant that you have a lawful basis to collect and process this information under the Protection of Personal Information Act (POPIA) and our Privacy Policy. You must not upload data you are not authorised to use.
8. API Access
If you use our API:
- Keep API keys confidential. You are responsible for all API activity under your keys.
- Do not share keys publicly or embed them in client-side code.
- Comply with rate limits and acceptable use. We may throttle or revoke access for abuse.
- API usage is subject to the same wallet, verification, refund, and prohibited conduct rules as the dashboard.
9. Prohibited Conduct
You must not:
- Use the Services for fraud, money laundering, or any unlawful purpose.
- Resell or redistribute recharges without authorisation where prohibited.
- Interfere with, scrape, or reverse-engineer the platform.
- Send spam, malware, or harmful content via SMS or other channels.
- Impersonate any person or misrepresent your affiliation.
- Circumvent verification or deposit limits.
10. Suspension and Termination
We may suspend or terminate your access if you breach these Terms, if we suspect fraud or abuse, if required by law, or if your organisation fails verification where required. Unused wallet balances on terminated accounts are handled per our Refund Policy. You may request account deletion via our account deletion page.
11. Limitation of Liability
To the fullest extent permitted by law, Shwi is not liable for indirect, incidental, or consequential damages. Our total liability for any claim arising from the Services is limited to the fees you paid to Shwi in the three months before the claim. We do not guarantee uninterrupted network or vendor availability. The Services are provided "as is" except where mandatory consumer rights apply.
12. Privacy, Changes, and Law
Your use of the Services is also governed by our Privacy Policy and Refund Policy. These Terms are governed by the laws of the Republic of South Africa. For questions, contact us at our contact page or hello@shwi.co.za.
